3M earplug injury lawsuits continue to mount in the U.S., as veterans and civilians claim the manufacturer knowingly supplied defective products to the federal government.

There are multiple lawsuits pending in courts across the country that have been delayed amid the COVID-19 outbreak, in which individuals say the 3M earplugs caused them to suffer hearing loss and ringing in their ears.

The lawsuits claim that 3M Dual-Ended Combat Arms Earplugs, known as CAEv2, were too short to fit properly in many soldiers’ and civilian contractors’  ears. The lawsuits claim that the defects were so widespread that some people were folding the end of the earplugs back to force them to fit into ears, leaving the susceptible to hearing damage.

3M agreed to pay the federal government $9.1 million in 2018, resolving allegations that it knowingly sold the military defective earplugs, but the money did not go to individual service members and contracted civilians. This has resulted in thousands of individual lawsuits, as people begin to seek damages for hearing loss and tinnitus.

Plaintiffs have argued that 3M used misleading data about effectiveness when acquiring government contracts for the devices. They also claim that 3M became aware of design fit flaws dating back to 2000 and individuals were never told about the issues despite the fact that the company was continuing to provide the devices.
